      Hi,
      Under public benefit land (definition no 2), am I right to assume that this definition covers all providers of registered child care services?

        Hi Ken

        I believe the process to be followed is to establish if the property use is in accordance with those listed under attachment C then verify it also meets Section 43 of the draft legislation.

        What I have done is looked at (wherever possible) all properties used in accordance with attachment C and then used the ACNC website to establish not-for-profit status.

          Bugger I read it like Ken.
          The only child care services that might qualify are the Council run centres.

            Since to be Public Benefit Land, the property is not to be used for a profit-making purpose, would that mean private schools would NOT be public benefit unless they could show they were not for profit? And what sort of parameters would show that the school was run not for profit?

              In the ESPL manual they provide a link to the Australian Charities and Not For Profit Commission. The ACNC website can be used to check the not-for-profit status of organisations.
