      The Local Government Act Bill amendments were assented yesterday, Mon 24 May 2021 – Act No 11 of 202.
      Please note that not all items in the Bill commence on assent and the following provisions (see attached document) commence on a day or days to be appointed by proclamation—
      (a) Schedule 1.1[2]–[4] and [7]–[11],
      (b) Schedule 1.1[13]–[15] and [17],
      (c) Schedule 1.1[19]–[31],
      (d) Schedule 1.1[33].

      Passed by both Houses

          Andrew,

          In the circular are you able to explain what they mean by point 6 under the Changes to improve flexibility for residential and farmland rates can also be used by all NSW councils which I have below:

          * The Act also allows for regulations to be made to specify circumstances under which the rating exemptions for land subject to a conservation agreement may be removed. This will not commence until regulations are made following consultation with key stakeholder to ensure incentives for land conservation remain in place.

            Yes, all the amendments regarding new or proposed changes to Sections 515, 555, 556 and 558 are to commence on proclamation, they have not yet commenced.
            The NSW Government will probably make regulations or such other instrument that allows councils to identify what land can be categorised ‘Environmental’ and what land is subject to an un-funded conservation agreement, I know they are working to resolve the issue.
            I am unsure when proclamations will be made and when these items will be resolved.
            Importantly the amendments that have commenced can now be seen on the NSW Legislation website.
