Just a quick update on changes to the Act regarding Sale of Land advertising, effective 1st of August 2018. see page 28 at https://www.parliament.nsw.gov.au/bill/files/3519/Passed%20by%20both%20Houses.pdf
S715 (1) has been replaced in a way that clarifies whether the sale must be advertised in both a Local newspaper AND a National newspaper (as well as the NSW Gazette).
The change gives Council discretion to advertise in a newspaper that satisfies Council it ‘is likely to bring the notice to the attention of persons who may be interested in purchasing the land’. The Newspaper has to be circulated in the area (or part of the area) where the land is situated, and has to be published in print form more frequently than every 26 days.
In practice Councils may decide that advertising in a Local newspaper satisfies the requirements of the Act and advertising in a National newspaper is not required. This could make a substantial reduction to the cost of advertising.
The new clause says:
Section 715 Notice of proposal to sell land
Omit section 715 (1) (a) and (b). Insert instead:
(a) fix a time and place for the sale, and
(b) give notice of the proposed sale by means of an advertisement published in the Gazette and in:
(i) a newspaper circulating in the area or part of the area in which the land is situated that is published in print form at intervals not exceeding 26 days, or
(ii) a manner that the council is satisfied is likely to bring the notice to the attention of persons who may be interested in purchasing the land, and

Insert after section 715 (1):
(1A) The time fixed for the sale must be no earlier than 3 months and no later than 6 months after the date on which an advertisement is first published in the manner determined by the council in accordance with this section.
