      Ok so I have had a number of enquiries regarding these lately and recommend consideration to the following steps when approached.

      1. Check to see if the property has been transfered by way of vesting, I believe that Section 22 of the Community Housing Providers (Adoption of National Law) Act 2012 negates the CHP from an exemption. We have checked vesting simply by looking at the last transfers in all cases the transfer has been from Housing NSW for $0, then followed up with checks in the Government Gazette.

      2. Obtain legal advice on the objects of the entity seeking an exemption.

      We were recently approached and the advice given was that certain parts of the objects were not percieved as being charitable and so we rejected the application.
