We have a situation in Lockhart where a property, leased from the crown, has accrued a few years of rates arrears. The person who originally leased the land has passed away a couple of years ago and the beneficiary of the Will has instructed the solicitors to not proceed with any further action on the will as they have no funds to pay. So the property has remained in the name of the deceased.
– The property is security for a mortgage with a bank.
– Crownland is also owed money for the lease payments.
– Indications from Crownlands rep, was that if Perpetual Lease was terminated Council would forfeit outstanding rates.
– As the intended beneficiary is sole beneficiary, indications are Perpetual Lease agreement is not being breached.
Does anyone have any experience or knowledge of ways to recover the Rate arrears?
