Essential Energy Classification

      How is everyone classifying Essential Energy? On page 17 of the manual it states that Essential Energy is not GOVT but then it is listed in Appendix B pf 32 under Public Non-Financial Corporations with NSW Housing (that is classified as GOVT). This does seem conflicting?

        Hi Deborah

        I agree this is confusing, but appendix B is intended to be a list of government organisations to assist with classifying as GOVT, meaning not all organisations in the list will be GOVT.

        Definitely, Essential Energy is not GOVT so the classification could be COMV/COMNV or INDV/INDNV depending on the use of the land. For example, it may be a battery storage facility which would be INDNV.

          I think, along with Aboriginal Land Council and probably other bodies, the definitions seem to raise more questions than answers.

          At least in the case of Essential Energy I can see them paying the ESL as they are not exempt from rates.

          However there is no way the Aboriginal Land Council will be liable as they are;

          1. exempt from rates under section 555.

          2. they meet the definition of a Council and according to the Classification Manual 3.1 Government Land is owned by a council.

          3. fully funded by Governemnt.

          At present I have Essential Energy as INDNV

            I think the definition of a Council for the purposes of the GOVT classification is actually referring to a Local Government Council.

            My response from Revenue NSW regarding Aboriginal Land Council’s was that they are not GOVT or PUBLIC and should be classified RES or COMM.
