Farmland for horses

      Hi All,

      I am wondering how many of you out there would grant the farmland rating category for horses?

      Gosford Council has always granted the farmland rating category for horses where the property meets the requirements of 515 of the Act, however, I am not sure that horses grazing could be considered ‘the business of grazing’. Cows, Sheep, Goats, etc. generally graze in order to produce some type of other product; meat, milk, wool, etc. Horses are most commonly used for showing, show jumping, recreational purposes, etc. Horses graze as a method of feeding but are often supplement fed also. The money made from horses is not necessarily a product of the grazing so can the grazing really be considered as the ‘business of farming’ in terms of the Local Government Act?

      I’m really just looking for some feedback on how other Councils feel that horses fit into the farmland category in terms of the legislation.

        We grant Farmland rating for horses providing that they meet our grazing citeria.

          Thanks Simone. I had already seen the previous forum discussion but was hoping for some more information/opinions on the matter. Would you mind me asking what your ‘grazing criteria’ is for horses?

            Hi Laura, our criteris is Minimum area 10 hectares, minimum stock 20 head, acceptable carrying capacity, qualifying stock not on agistment, relevant infrastructure such as dams, corrals, loading/unloading ramps, secure & appropriate fencing

              Hi Laura,

              Camden Council does not allow farmland rating for horse studs, horse training facilities and properties that allow spelling or agistment of horses.
              Council’s Farmland Rating Policy is very specific about not allowing farmland rating for horses.
              The Camden LGA has a large number of horse studs and with the upgrade of the Menangle Park trotting track a number of trainers have moved to the area and built training facilities. Any farmland rating applications from these new ratepayers has been declined.
              Council was taken to court in relation to the a horse stud and farmland rating some years ago (Clinton v Camden Council) and Council was successful.

              I believe that most Councils allow Farmland Rating for horses but its a decision for each to decide.

                Hi Laura

                We have quite a few horse studs, agistments etc and once the application comes through I refer them straight to Council’s independent farmland inspector – Peter Cowman.

                He will go out and inspect the property and give Council a clear decision – this way we have done it fairly.
