Hi Team,
Our planning team notified me of the following from VG’s https://www.nsw.gov.au/sites/default/files/noindex/2024-05/Valuation_of_heritage_restricted_land_.pdf
Which was published earlier this year.
They are questioning if they should be advising land owners to apply for rating discount. We currently have about 13 heritage properties that are listed on the state register, but we have 500+ under an LEP, which the document seems to indicate that they can apply to VG under 14G of the valuation of land act and VG will make a determination if they qualify.Anyone seen this before or might be similarly impacted?

Not sure if the planning team is telling people already but i have just had a customer request lodged from a ratepayer to seek heritage discount under the LEP.
Is there an indication on when we will get some guidance from OLG?

I am following the VG up with this issue today, our next Executive meeting is Monday 19 August.
From what I can tell the issue is around the VG’s discretion to decide if it is reasonable to value the land as heritage restricted under section 14G based on conditions within a councils LEP and we need to know how this will impact councils.
Have you received any valuation changes based on the heritage items listed under the LEP? If so, could you share directly with me as a practical example, or just the PID.

No, we havent received any valuation change. The request is from the ratepayer seeking information on if they are entitled to a discount under Heritage.
The property has a land condition titled “Heritage Item – The House”.
I can hold off on responding to the customer but probably only for a few days.

At our August meeting we discussed this issue. The RP executive have been advised that if the land is identified as a heritage item within the LEP, the VG will value the property under S14 VLAct1919.
The valuation would be based on the assumptions below:
14G Valuation subject to heritage restrictions under EPI
(1) Land that is heritage restricted on the date by reference to which its land value is to be determined is to have its land value determined on the basis of the following assumptions—
(a) that the land may be used only for the purpose, if any, for which it was used when the value is determined,
(b) that all improvements on that land when the value is determined may be continued and maintained in order that the use of that land as referred to in paragraph (a) may be continued,
(b1) that all improvements referred to in paragraph (b) on that land are new (without any deduction being made because of their actual condition),
(c) that no improvements, other than those referred to in paragraph (b), may be made to or on that land,
(d) that the cost of construction of improvements on that land has no effect on its land value, with the result that there is to be no reduction in land value because of any difference between the cost of construction of the improvements referred to in paragraph (b) as new improvements and the cost of construction of other improvements used as a basis for comparison in the determination of land value -
