Mixed development – old and new Act

      Hi there

      This is an appeal to those that remember the 1919 Act well ….

      Was mixed use, MDAF, rating around under our old Act?
      If not, was it introduced with the new Act in Jan 1994 or was it added later? If added later, when was it added? When did MDAF show up in the VG Act?

      How was dominant use determined under the old Act? Example; flat building of six units. One unit used commercially as a finance brokers, the other five units used residentially. The zoning permited both commercial and residential use. What category for rating would have applied to this block under the old Act?

      Any information would be of assistance.

        Yes, we had MDAFs in the olden days, (Section 118(6A) of the 1919 Act.
        The basis of determining dominant use was no different to now.
        In your case it most likely the property would be subject to the general rate (which now would be equivalent to the Residential category of the Ordinary rate).
