Pro rata rating

      To those councils that do pro rata rating during the year following sub-division of a parcel of land, could you please advise how you deal with an overpayment on the parent property, and the basis of your decision. Thank you

        Unless we are advised by the payee to allocate to the child properties, we refund any over payments back to the payee

          Just wondering if any Councils have been challenged by solicitors on Part Year Rating stating that the LGA does not allow for it?

            20 years at Bankstown and a couple of years at North Sydney – questioned but never challenged.

              Hi Carla, Randwick has been pro-rata rating for about a decade. Rarely questioned and not challenged.

                Anita, we contact the ratepayer/developer/solicitor and advise there is a credit and ask for instructions. 9 out of 10 times they request the money back, the justification of this is the majority of time we don’t know who has paid it especially if its paid through BPay, Australia Post or there is settlements taking place.

                Carla in answer to your request Wollongong commenced pro-rata the same year Shellharbour did and we have had some questions from solicitors over it, but we have not be challenged in court.
