As I mentioned at the conference, Section 603 of the Local Government Act 1993 does not require the ratepayer’s name to be included on the certificate.
The only circumstance in which the name must appear is when the property was acquired by the owner under Division 5 of Part 2 of Chapter 17—that is, where the land has been subject to Sale of Land by Council for unpaid rates. This is set out in Section 603(3)(d), which specifies that the certificate must state “the name of the person shown in the council’s records at the date of the certificate as the owner of the land, if the person acquired the land under Division 5 of Part 2 of Chapter 17.”
Having the ratepayer’s name on the notice where it is not required under Section 603(3)(d) may, in my opinion, be considered a breach of privacy.
