Recommencement of Legal Action?

      Hi everyone,

      I am enquiring about which councils have recommenced legal action.

      Can you please advise:

      1) Has your council recommenced legal action?
      2) If so, when?
      3) Have your thresholds for action changed?
      4) If you haven’t recommenced legal action, when do you think you will recommence?

      Penrith City Council hasn’t recommenced yet but we are looking at starting early in the new year 2023.

        Hi Matthew,

        Yes we have recommenced legal action and did so from January 2022. Our thresholds have not been adjusted.

          We recommenced legal action from July 2022 and we have not changed our thresholds.

            Hi Matthew,
            We recommenced in July 2022. We haven’t officially adjusted our thresholds but since costs have increased we were abit more selective with the accounts we proceeded on for our first round of action & we also phoned or emailed each account (where possible) prior to proceeding to the SLC if we hadn’t previously spoken to them. We may look at increasing our thresholds when we next review our debt recovery policy.

              Hi Matthew,

              FCC recommenced legal action from July 2022, but we had to put in place some steps prior to selecting the account for legal. We had to exhaust all avenues first, attempt to call three times where a number is available, email where possible, and send a soft letter to property and postal address advising legal is going to proceed if no contact is made to council, once we have exhausted these steps then the account is to proceed to legal, and we have not changed our thresholds.

                Hi Matthew,

                Blacktown recommenced action in March 2022.
                Our thresholds increased slightly due to the increase in costs but we have tried to exhaust every avenue first (email, phonecalls and sms) to contact customers before we proceed with SLC, more so that what we are doing previously.

                  Hi Matthew,
                  CBCity recommenced action in April 2021 and then it all crashed again in July 2021. We held off on proceeding further with any of the open actions until early this year. We sent updated balance letters in February/March this year, requesting contact or we will recommence. We did our first full run in April 2022 and have changed from 2 runs a year to every quarter, so we have done April, July and October so far this year. We haven’t increased our threshold either, it is still two full instalments totalling $750 or more. But with our minimums increasing again next year, it is something we will need to look at.
