Hello friends,

A Church purchased an RMS building and received approval to change the use to a place of worship. The Church applied for non rateability which we have approved effective 1 July 2023 in accordance with 555 1 e i. The effective date is based on date of application.
They are disputing the effective date how do they go about a review.
Has anyone else had the effective date disputed and if so, what legislation did you use?

Hi Karen

The Act provides a review process under Section 574 to the Land and Environment Court within 30-days of the notice being served.
I have had this happen before and provided the applicant with a short statement bringing the section to their attention.
