Sale of Land by Private Treaty following 713 Sale

      Hi all,

      Can one of you brilliant revenue officer out there tell me how long a council has following a 713 sale, when a parcel of vacant land has been passed in, to sell it by Private Treaty.

      There is no mention of a time scale in Sec’s. 713 to 726.

      I would assume it can’t go on forever & if a significant amount of time (eg. years) has passed we should list it for sale again at the next 713 sale.

        In my opinion I don’t believe there is a limit on a private treaty and why would you want to incur costs again in going through the whole process for the sale of the property again the following year.

        Having satisfied all the conditions of 713 I would continue to try and sell the property by private treaty and when/if you find a purchaser they will apply for a 603 which will let them know all outstanding rates and charges on the property if further rates and charges have been levied.

        It might worth getting a legal opinion.

          Adding to Robert’s comments above, which I 100% agree with, I would firstly discuss with the appointed agent (assuming there is one appointed).

          There may be covered in the legislation/regs/best practice guidelines etc under which they operate.
