Special Rate – Private land

      Hi everyone
      We have had and enquiry regarding maintenance and management of ROC and other private land (eg Private roads) and if Council could take on the care/management of these spaces and add the cost to the rates, to be paid off by the ratepayers.
      Has anyone received similar requests?
      Does anyone know if this is possible?
      Any case law that may be relevant?
      Any thoughts on if we can use Section 495 to levy a special rate
      – My thoughts were that Council could use S495 for a special rate for works/services on council owned/managed land.
      It isn’t specific on the ownership of the land eg if it can be on private land.

      I appreciate any insight anyone can provide greatly appreciated

        Hi Lyndal
        Not sure if I am understanding the issue here properly but councils can levy a special rate ‘towards meeting the cost of any works, services, facilities or activities provided or undertaken, or proposed to be provided or undertaken‘ by the council.
        If I am understanding this correctly it looks like you can levy a Special Rate.
