Termination of a Strata Plan – Form 15ST

      Hi all
      I have a bit of twoing and froing going on regarding who is responsible for signing a 15ST Form.
      We have received this form from a solicitor wanting to terminate a strata Plan, i have confirmed that the rates have been paid in full for all the lots in the plan, but they want the form signed by an authorised person in the Council.
      I have never had one of these before and I am in the dark as to who would be the authorising signatory??
      Any information you can provide me with would be extremly helpful and as soon as possible if you can as the solicitor is following up on this almost everyday now.

        Hi Glynes,

        Your council will need to has adopted an authorised officer in its delegations. At our council, these are approved by a manager in the Planning department.

        Try searching your document management system for ones done in the past.

          Hi Glynes,
          Manager Development Services has delegation here. Rates would only become involved once registration has occurred & changes were required to rate accounts.

              This has cropped up at our Council recently as well.

              We had a senior planner signing off, but no checks in place about debts about land, in one of the recent examples we had about 50% of strata units that had a debt attached to it.

              Legal have asked me for advice what happens with the debt on the land.

              I note up the top of the form it mentions before signing to complete the steps in the info sheet I circulated below which talks about debts, so I imagine the onus would fall on us if we got put to the test in court.
