Updated advice on item 2.5.7 Under development or construction, with intended use mainly residential

      Revenue NSW and Treasury have updated the manual and provided further clarification on the DEVRES specified use for land under development or construction, with intended use mainly residential.

      Please see the updated manual (attached) for the detail.

      This means, Greenfield developments that would be classified RESV and are under construction but not yet completed do not need a Specified Use.

      The underlying intention of the classification is to identify growth factors, meaning if the land is currently valued/rated as one property and is under construction to become many residential properties you do need to identify these with a DEVRES specified use.

      If you have identified Greenfield residential land and added the DEVRES Specified Use, dont remove these as Revenue NSW is aware that councils may have taken this action and it will not result in an error file.

      This is an extract from the manual on page 16:

      Section 2.5.7 requires councils to identify parcels of land within their area that have received Development Application (DA) approval and a Construction Certificate (CC) but have not yet received an Occupation Certificate (OC). For these parcels of land, councils are to identify their likely future use once development is complete.
      While councils are encouraged to take reasonable steps to identify parcels of land that meet the conditions set out in this section, particular focus should be given to the cases where the land classification of a parcel of land under development is likely to change once development is completed.
      For example, this would include parcels of land that are classified COMNV – commercial non-vacant – and are under development/construction for residential dwellings. These parcels of land would be classified RESNV – residential non-vacant – in future once development is competed and the OC has been issued. Under section 2.5.7, these properties would be identified DEVRES under ‘Specified use’.

        Thanks Andrew. I really was astounded that they had stipulated a requirement for all greenfill parcels to be individually checked for DA and CC, even after they were advised of the volume. This makes much more sense.

            Does the DEVRES also apply to parcels of land categorised residential under development for a single dwelling or is more for multi occupancies?

              Hi Anita

              No, the DEVRES does not need to be applied to single dwellings under construction.

              The underlying principle for DEVRES is to capture uplift from one property to many properties such as single property into 10+ apartments that is currently under construction. Dual occupancies and secondary dwellings need not be identified for DEVRES.

              Treasury and Revenue NSW are aware that some councils may have identified more than they needed to and are ok to receive the additional data, so if you have (or anyone else that reads this has) done that you don’t need to change anything.

                Thanks Andrew, Another question we have a lot of Over 55’s villages eg Palm Lake Resort, RSL Lifecare etc the DA was approved as a caravan park but they are large 3 bedroom houses we are not sure whether to classify these as COMNV OR RESNV? Also would they have a specified use of RVAC?
