Please take the time to consider the judgement:

      http://www.caselaw.nsw.gov.au/action/pjudg?jgmtid=170495

As I understand it the matter has been appealed by VG but it may drop the appeal.

It appears there are other Councils that will be effected by this NSC being one. I have had a call asking how much it will cost us if this isn’t appealed & the rationale of the appeal is applied to at least 1 property within our area.

The cost would be approximately $6,000.00 pa to NSC which we would be expected to refund to the customer. I guess this will be recoverable by SS9.

However logic tells me that as the proposed BD 2010 valuation will be less than both BD 2007 & BD 2004 the owners will also want something done about those. This could result in a refund of approximately $55,000.00.

None of the above takes into account the BD 2013 valuation which is currently being used.

      FYI etc.

Just another example of LG being the poor relation.

G’day JT – I’ve read the material – thanks for sharing.

Can you clarify what it is about this case that could affect other councils? Is it the owner Fivex Pty Ltd or an LEP change (or something else)?

        Thanks and regards, MO.

          Hi MO,

As I understand it it’s the LEP & it’s application including application (or not) of highest & best use.
