Court Instalment Order – Rates over 5 years

      We have a property with a current Court Instalment Order which will be paid in about 4 years time. The rates are in arrears by over 6 years now and by the time the Court Instalment Order will be paid they will have over 8 years in arrears. Are we able to sell the property even though they have a current CIO? We did object to the CIO at the time of lodgment but it was rejected.

        Hi Kylie,

        To the best of my knowledge there is nothing to stop a Council selling a property which is subject to an instalment order, it certainly isn’t covered in the LGA. However I’m not sure that you would want the publicity & flack that it might attract.

        You can always go back to court asking for the order to be amended giving your reasons as to why.
