We have received correspondence from the family of a pensioner whose rebate we have reversed as the pensioner is in a nursing home and the family are commercially renting out the property. The family are disputing the reversal on the grounds that they have been advised that under Federal Law she is allowed to have her home rent exempt because she is in an Aged Care Facility and is paying a daily fee and an accommodation fee.
We do allow the rebate to continue when the pensioner is in a nursing home and the property remains vacant or occupied by the pensioner’s partner. This is covered by the Council policy.
Is anyone aware of a scenario where – a pension rebate has continued to be applied even though the pensioner is in a nursing home and the family are commercially renting the property out. The family are claiming that the rental income is not enough to sustain the upkeep of the pensioner in the nursing home and associated costs.
We are not aware of any situations like this so any comments are greatly appreciated
