Following todays news report that AP may move to less delivery days as early as December this year I asked OLG whether there had been any move to change allowable methods of service eg “BPayview”. Obviously we are going to need to look at methods of service particularly if the current major method is changed.
They have responded with the following:
The service of notice issue, and technology in general, was a matter dealt with by the Acts Taskforce. The Taskforce recommended in its final report the following: “(1) as a general principle the Act should enable optimal, flexible and innovative use of technology by councils to promote efficiency and enhance accessibility and engagement for the benefit of constituents; and (2) the Act should allow each council to determine the most appropriate use of technology taking into account the Guiding Principles of local government and community engagement through the IPR framework”. As you would be aware, the Government is yet to release its response to the Taskforce Report, so I’m not in a position to comment on if or when the Act would be amended to create more flexibility for electronic delivery of notices. Having said that, I will make it known about the Australia Post issue and potential implications for councils.
