Depends on what stage of debt management the arrangement was struck, ie. pre or post Letter of Demand. If the progression of legal action was stalled by the establishment of an arrangement, failing that arrangement would likely tip off into a recovery situation (after a broken arrangement letter) .. within the scope of our debt recovery policy.

If you don’t have a framework or policy that guides consistent discretionary decision-making here you may end up in an unintended tough space. I agree, the peeps who know stormwater (and how it runs off in major storm events) are the ones who should probably come up with the guidelines.
Does your Council have a stormwater management charge policy? Shoalhaven does, I’ll email you a copy.
Every Council is different of course. Personally, I’m always inclined to keep the gate fairly closed with Stormwater (if I can). It is a nominal charge (unless some huge business site). How much Admin do you want to wrap around a $25 charge? In most locations it can be argued that very few properties have completely adequate storage for stormwater run-off in a major stormwater event. Of course some will have fabulous set ups but most don’t. Somewhere water runs off their land and on to someone else’s land and likely into Council’s stormwater infrastructure at some point, and at $25 per year, best not to have administer and adjust fees.Hi Karen
If an On-site Sewer Management (OSSM) line appears on your Rates Notice, you council must be adopting it as a “charge” rather than a “fee”, and if so, it is likely an annual charge via s.501. If adopting as a s.501 charge, it should appear in your Op Plan as part of your Statement of Revenue Policy and also be “made” by Council resolution s.535 (and therefore be included in your making of the Rates report).
It seems that a good few councils are now putting an OSSM annual charge on their rate notice. And as I understand it, this represents a shift from a fee (as per the Fees & Charges) to an annual charge (as per the Statement of Revenue Policy). And despite having a recently implemented s.501 OSSM charge here at Shoalhaven, I’m not fully across how this shift originally derived within the industry (i.e. I believe some councils have been doing this for a good while).
Is this your council’s first year adding an OSSM charge to the Rates notice?

Shoalhaven does restrict meters … after Reminder > Final Reminder > Registered Letter > Notice of Intention to Install a Flow Restrictor (hand delivered).

There was quite a bit of valid flack about equity from ratepayers who could no afford to pay rates in full (being precluded). But of course that was a pay annual rates in full scheme. -
