Hi Michael,
We issue two notices, one to the owner, and one to the agent, at their request (these are done as a batch of PDF- to reduce costs).
We have made it very clear that responsibly lies with the owner. This is for rates or water.
We are small Council, with a good relationship with agents…touch wood, we haven’t had any issues.
Is it clear what date we put on notices for the due date?? 31/08/20 or 30/09/20
We will be sending in July as per normal.
Very interested to hear how Councils are going to be able to ‘consider a-d’ of the new legislation.
We aren’t doing much (barely any) debt recovery, however I do need to move forward on one ratepayer. (significant debt, recovery had commenced prior to COVID – and pretty confident the Ratepayer isn’t covid effected)This is my take/consideration on moving forward with this account…thoughts would be appreciated.
(a) whether the payment of the rate or charge could be made in instalments or by way of some other financial arrangement
Yes – it could, and yes Council would be open to an arrangement, this is difficult to achieve when the ratepayers doesn’t contact Council.(b) whether the person should be referred to a financial counsellor
Yes probably, can suggest, but how long do you wait for them to initiate this process, in rural areas, finding one is also challenging – noted the four services provided in the Q&A.(c) whether mediation or alternative dispute resolution should be attempted first,
not sure how you tick this box….I feel like I do this in step a.(d) whether interest on the unpaid amount should be deferred or waived
Yes naturally this could be an option – which is reasonably easy to initiate.And, I presume if I tick all the a-d boxes, I could proceed with the Statement of Claim.

We haven’t made an official decision yet, however leaning to business as usual. But keen to hear what others are doing…my fear is for ratepayers who have land in various shires there could be confusion.

I was fortunate that the Services NSW girl was local, really helpful and brought brochures in explaining the program, she also knew her stuff as well….so we haven’t been faced with any odd applications, just legitimate ones.
There is some proposed in Inverell. Moree has one, and it is rated business.

In terms of being better of worse off.
Here is in Inverell, the residents are handling it pretty well, I am personally worse off, 15-16 paid about $98 in ESL, in 16-17 (renewed in April), paid $60ish, under FESL I will pay about $115. However a colleague who has just bought her first home in April 17, paid $215 ESL, and will pay $120ish under FESL. Our insured amount is very similar. Approx 300K
I can see our Farmers may not be better off, as many of them may only insure their house and sheds, which would not be close to their ULV. Our highest valued farmland property in the Shire will pay $4,101.00 in FESL
