MaryI have been discussing the new interest rate supplied by OLG and it seems there are two ways of interpreting the interest charges.
Having a 0% from 1/7/20 – 31/12/2020 is the easy part and gives ratepayers 6 months to catch up but when we set up the interest rate from 1/1/21 for the 7% are we able to backdate interest on any arrears still outstanding OR do we commence the interest rate from the 1st January and not let it back date any interest.
I’m more inclined to think that the OLG mean that interest should only apply from the 1st January and not be backdated but would appreciate how other Council’s view this.

Totally agree with you and we would normally have said a quick No to this ratepayer but after discussions with Andrew feel that Service NSW should not be putting this on their website advising ratepayers that they are entitled to a pension rebate on water if they have a life tennancy agreement and are a eligible pensioner, hopefully we will have some feedback from Service NSW soon.

I have the Werin Aboriginal Corporation who have recently purchased a Medical Centre requesting nonrateability. They purchased the property in their name with a mortgage to Indigenous Business Australia. They have supplied ABN & Charity Register advising they are Australian Charities and Not for profit and Public Benevelent Institution. Their rule books states their objectives include Delivering free culturally apppropriate holistic health, training to Aboriginal people in Port Macquarie however it also states that they can establish and operate business ventures which will generate income to support the Aboriginal Community of Port Macquarie. Winding up section states that if they are dissolved all property and monies must be transferred to a similar charity.
I’m inclined to given them the nonrateability however just wanted to check with other Council’s if they have received any requests like this one and how they dealt with the application as I believe we should be consistent with our decisions.

MaryThanks Andrew, Yes we are also commencing a fee for providing copies of notices from 1 July, however current and prior year will not be included.
MaryYes all done and in Authority – just second gussing some of my entries and going back over them to make sure they are correct. Noticed in Release 3 that they have now defined nominal rent as “heavily discounted rent” (eg quarter of the maket rate) which would not be considered as “nominal rent”. We have a few properties owned by Council which are leased but only leased at 1-10% of the market value which would be well under their description. Do any other Council’s have the same situation if so what have you coded them?
MaryI was under the assumption that the ESPL will only be levied on the portion of rates levied for the House etc and not the land that is under the conservation agreement. It may be that a manual calculation will need to be done for these.
This would also apply for postponed rates and the ESPL would be levied only on the rateable land value and not the portion which is postponed.
If anyone else has further information please let us know.

MaryThank you all for your comments and Matthew I have since downloaded the Gazette and all the properties they are seeking exemption for have been vested from NSW Housing although the title searches do not say they are vested under section 22 of the adoption of National Law Act 2012 – I will decline their application and see what happens.
