So sorry to hear this sad news. Robyn was a lovely person, who I had the utmost respect for as a fellow Revenue Professional. My condolences to Robyn’s family.
Hi Jo-Louise
THe Valuer General have a list of policies on the following website that may be of assistance with relation to your question on developer allowances.
http://www.valuergeneral.nsw.gov.au/publications/policies
If, after reading the information, you are still unsure it would be advisable to refer the matter to your legal advisor for clarification.

TrevorHi All
Thanks Tracey
Appreciate the advice and update from IN. Ran the process a while back and came up with errors so will try again.

TrevorHi Graham
Blue Mountains follows a similar process.
If raised in error we reverse them as part our normal processes.

Not sure of any other Council’s that may have solar farms being built in their areas so Parkes may well be the first one in NSW.
I think you would need to treat solar farms in a similar manner to the way that wind farms are categorized and rated.
There is a previous post under the Categorisation subject regarding the rating of wind farms so that may be able to assist you in determining the best way forward with this issue.

TrevorHi Lisa
Blue Mountains has online payments through our Council webpage. We are NAB and Pathway so no real help.
Try talking to Mary up at Port Macquarie. They are Civica, have payment on their Council’s webpage, have water. Can’t recall which bank Port are.
Hope that helps.
TrevorGood Afternoon Everyone
Thanks for the feedback and sample certificates that have been sent through to me.
Really appreciate the assistance as it has highlighted that our Section 603 certificate needs a bit of tweaking to improve the current level of information we include.
Hope to see everyone at the Conference.
Best Regards
TrevorHello Everyone
Not really sure about this form as it appears to be missing details regarding MRCA pensioners which were included on previous forms. Or am I just getting forgetful and thought it was previously included?
Like Ken I also tried to ring OLG to discuss. Will need to follow up next week when OLG are back on deck.

Good Afternoon Graham
Not sure whether DLG Circular No 09-34 will be of any assistance in solving this problem for you. If you don’t have a copy of the circular let me know and I can email you a copy.
We take the approach that if the ratepayer provides a copy of the necessary paperwork indicating that they are in receipt of the MRCA paperwork they are eligible to receive the benefit of the rebate. Regular confirmation checks are undertaken to confirm ongoing eligibility. As there are a relatively small number of MRCA’s it is not difficult to keep a track of them.
Think you will find that MRCA’s do not receive the PCC Entitlement as their payments are made under a different Commonwealth legislation.
In short I do not think there are any grounds not to grant the rebate that has been requested by your MRCA ratepayer.

TrevorHi Janette
Blue Mountains rate them as Business and no donations.

TrevorGood Morning Everyone
A quick question on the issue of PCC reinstatement.
As everyone would know the reinstatement of the PCC has started happening. Date of entitlement showing on the cards is 9 October and we are granting the rebates effective from that date. So far so good.
Most ratepayers are happy to just be reinstated. However we have a number of customers who are jumping up and down and carrying on about having to complete a new application form.
Customers are saying that when they ring Sydney Water to advise of the PCC reinstatement they are reinstated without being required to complete a new application form.It has always been my understanding that if you lose eligibility for the rebate you are required to reapply. A new application form needs to be completed including the customer’s signature to confirm ongoing eligibility.
My question is how are Sydney Water able to reinstate by only receiving the details over the phone?
Would be interested in hearing comments from other Revenue folk.
Thanks

When I was working at Hawkesbury Council many years ago there were a lot of turf farms. They always used to be categorized and rated as Farmland.
Not sure how Hawkesbury treats them now. Give Dave Nelson a call.

TrevorHi Emma
An interesting question. I recall there being a post back in 2008 regarding the rating of wind farms and whether they should be rated and categorized business. You can view the post in the archives.
I agree with Andrew. Should be business. Does not fit under the category of farmland. Definitely not residential or mining.
As the parcels of land are leased all the more reason to be categorized Business.
I know that out at Blayney, down towards Goulburn and near Lake George (on ACT border) have wind farms. Perhaps it may be worthwhile ringing those Councils to see if they can assist.

I have always taken the approach of rating Council owned car parks as Business because they are Operational Land.
Then again there was a legal opinion kicking around from one of the Councils a while back that indicated all Council land should be exempt.
Will be interested to see what everyone else has to say.Regards

To the best of my knowledge there have not been any announcements from the NSW State Government regarding rate capping or pegging for FESL.
The questions you have raised are not ones you should be answering. If there is to be a change in the calculation method this advice would need to come through from NSW Treasury.
In the interim I think the best way to handle these enquiries is to refer them to the FESL hotline.
Hope this helps.
