      Hi Leonie,

      Firstly, I’d contact the common and frequent applicants and let them know that you won’t have the rates levied until xx/xx/20. I would suggest to them that they only make applications during July if they are settling in July and I would send each of them a link to the draft Op Plan.

      Secondly, I would not put the proposed levy amount on the certificate. I would note that the 2020/21 rates are not yet levied and that prospective owners are advised that they will be levied on xx/xx/20. I would also note that the draft Op Plan can be viewed at www…….

          A change in the form does not change the legislation. The entitlement of 100% for husband and wife has not changed.

          Councils just need to understand that they can’t do a Centrelink check on any person that has has not completed the form and authorised the check.

            Hi Jason,

            I have always thought FESL would come back but it’s just a matter of when. I doubt they will rush something out without appropriate planning. NSW government can’t afford to get it wrong again.

            We aren’t spending time maintaining FESL classifications as they could be defined differently next time around.

            I guess it depends on your system as to whether it’s simple enough to maintain strata PIDs but if it comes back we will likely work on another bulk upload.

              The solicitor is right. There is no obligation to pay any rates on settlement. Any unpaid rates and charges will simply become the responsibility of the new owner.

                  Hi everyone,

                  Firstly, thank you to Andrew for coordinating the NSWRP response. This is a unique opportunity to debate important items in our industry to hopefully achieve significant changes.

                  The one thing that has been difficult is modelling CIV and the calculation of growth as proposed by IPART without CIVs on hand.

                  I have recently obtained some data from Melbourne City Council published reports that shows the valuation changes from property growth during 2014/15 and again during 2016/17. In both of those years, the number of rateable assessments grew by 9% but the overall CIV only grew by 5%.

                  In short, it shows that the average property value reduced and therefore the average rate would reduce, making it unlikely that the growth would be sufficient to cover the increased demand in services.

                  My suggestion is to use the CIV growth formula as proposed by IPART but make it subject to a minimum growth calculation that would ensure that the average rate per rateable assessment would not reduce.

                  I thought I would share this for all members to consider including in your council’s submission.

                    No, the City doesn’t extend a concession to holders of the Seniors Card.

                    Sometimes customers might misunderstand the information provided to them but if you have more details, multiple instances or evidence of Service NSW making this statement, the Exec will take it up with Service NSW.

                        The City used s511 recently to catch-up a significant amount of shortfall. Although the shortfall was not related to an SRV, I think it would be beneficial if we spoke.

                          Do you mean how might you practically implement on the system? You would have to look into your software capabilities for this one. The City of Sydney operates under both the local Government Act and the City of Sydney Act. The latter allows us to cap rate increases on individual assessments, so we have some experience at this but we haven’t needed to use these powers for a few years now.

                          Some rating software systems have a rates capping option of some sort. I would recommend approaching your supplier for their advice.

                              Latest update: the Court of Appeal ruled in favour of the councils and dismissed the LEC ruling.

                              Karimbla sought leave to appeal to the High Court but the High Court today dismissed their application. This means that the decision of the Court of Appeal stands.

                                Hi Dallas,

                                Someone else may be able to confirm this but I understand that if you allow Centrepay as a payment option, it will be available to anyone who receives any sort of payment from the government. You can’t restrict the payees to just your pensioners. However, the number of users at Campbelltown quoted by Andrew might indicate it’s not a very popular payment method anyway. Further numbers from other councils might help you to advise Councillors on anticipated costs and benefits. It’s not offered at the City.

                                  I don’t think you’d have any legal issue levying the rates from date of purchase. The 603 certificate was accurate and disclosed amounts due and payable at the time of issuing. Rateability only changed after the purchase and you’re not making any changes to the amounts payable for periods prior to the certificate issue. You may wish to obtain legal advice.
